He got married 2 years back...he is not having any physical relationship with his wife for more than a year and now things between him and his wife are worst...please do tell me how to get divorce from his first wife and how to get custody of his child..and then how we can be legally get married...i know u will suggest me to leave him ..but this is not possible for both of us...we want to marry soon and i am ready to keep his child...please reply soon its urgent..

Number of time I ask anyone seeking legal advice regarding Divorce etc should always mention the religion of the parties & form of marriage they had gone through. In India there is no one single matrimonial law regarding these issues like divorce, maitenance, custody of children etc but different laws exists based on the religions of the parties. Now coming on the issue mentioned in this case, assuming the parties in dispute are Hindus & married according to Hindu form of marriage, they can proceed for divorce on mutual consent according to section 13-B of the Hindu marriage Act,1955. This is the easiest & most convenient provision. Any divorce on mutual ground will take about 6months to a year period. If any party to the marriage is not agreeable on divorce by mutual consent the only ground which I find in this case is cruelty, on this ground the divorce can be obtained if the cruelty has been for a stretch of time & has broken the matrimonial home beyond any repair. As far custody of child is concerned the court decide keeping in mind the cardinal principle of welfare of the child, for this financial status of both parents, educational status of both parents, time for child, development of the child, education of the child, age of the child , marital status of the parents after divorce etc has to be seen. AreYou the reason they are not having any physical relationships? how sad a child is involved here too...If he's cheating with you and gets divorced most likely the judge will favor with the wife, they have a child together, he will be paying child support, and have an ugly divorce, he'll be left with hardly any money between child support and alimony. I would leave him and never look back,married people fooling around isn't always what you think will be a good out come. who says he wont cheat on you after if you ever do get to marry him.this is a long process.

Do not get married to him. He is absolutely cheating u & u r being greatly cheated. A good & sincere married man does not adopt such selfish negative trick. Don't exploit the man if his married life has adjustment trouble. A good lady must try to help him out positively to put back his married life on track rather than going for such plan of doubtful outcome, in future. U too may come across similar problem with this man in future. It is immoral & a conspiracy too to try a married man to divorce his wife & marry a woman having an affair with him. I would never advice for such plan. What about the child & what is his fault that u r planning to spoil his future by snatching his mother. Managing a child is not easy. Only a patient mother knows in a nuclear family. Please be God fearing & don't think to work to snatch(steal) the husband of a , may be a good housewife. How can u believe what he says about his wife is correct. At least u can be called an exploiter & not a well wisher of someone in trouble.Bury your relation with him forever. Safety rules for life says : SAFETY FIRST , ANYTHING ELSE LATER. But u r jumping in an unsafe zone. May God help you.

If your in the US, then divorce is not difficult. However, custody of a child is another matter. I don't think you two will get total custody unless the mother decides to give it up. I would imagine that to be very doubtful (there aren't too many mothers that are willing to do that).
Yeah, my advice is to leave him - he's married - happy or not.

Most fo the people who asnwered you are correct. In the US you can get a dirvorce over anything. Getting custody of his child is another matter.
But your are fooling yourself. He is still with her and you are out here asking for info on how to get HIM divorced from his wife. Now divorcing his wife is something he should be doing. You cant make him.
His wife is a fool for keeping him and your a fool for wanting him.
PS unless he is with you 24/7 how do you know he isnt having sex with her?? They are married.

You are also taking his word that he wants to leave her for you and has not yet to contact an attorney. Stay with him, find the wishing star, and all your wildest dreams will come true. You may very well be "ready to keep his child" but I would think that the child's mother is ready to keep it as well.
If he is so miserable and wants to be with you then he needs to get out and then start a relationship with you.
Something to keep in mind.....when the husband leaves the wife and the mistress becomes the new wife there is a job opening as a new mistress that may very well get filled by someone else.
