I recently bought Borat the movie from frys electronics. It turns out it was pirated and fake. Is this illegal if so, what can i do? And also if I can sue, how much should i sue for??

you can sue for actual damage, which is in this case, the price of the tape/dvd. hardly worth going to court. however the movie company might pay you a bounty for turning over evidence that they could use. they can sue for statutory damage which would apply to every single tape sold by Frys.

Yes, Borat is under copyright law. What you should do is contact fry's and ask them about it first.
