News Ltd did not permit an advertiser to put an email address in an ad in the Courier Mail. The advertiser took legal action against News Ltd and won the case. The judge ruled that News Ltd was restrictibg the advertisers FREEDOM OF Speech. Who was the advertiser and what were the details of the case?

As to the previous answer - I wish Americans would stop thinking their laws apply throughout the world! We don't have the bloody first amendment in Australia so butt out if you have no idea what's going on!

As to your question - I'm a lawyer in Qld and I don't recall any such case. I have searched the judgments both on the Qld Courts website (www.courts.qld.gov.au) and on Austlii (www.austlii.edu.au) in case it was brought as a federal matter, or was appealed to the High Court, and cannot find any case which seems close. Have a search yourself on those sites to see if you can find the case you are looking for.

I have no clue about the details of the case or the advertiser in question. I will say that if your description of the case is accurate, the judge was WRONG. the paper has the right to refuse ANY advertisement for ANY reason. The 1st amendment prohibits the GOVERNMENT from restricting speech, or in this case the press. It DOES NOT prevent press outlets from exercising their own right NOT to print something.

Freedom of speech is the devine precise of evrybody. Err, nicely, that's what human beings think of, yet if actuality be told it would not seem that way. seem up Freedom of Speech in Wikipedia and notice what share regulations on the liberty of speech there are and you would be shocked. it type of feels there is no longer the type of component after all.
