My ex-husband owes about 10,000 in back child support. I dont want the money nor do i need it . My fiance and I have supported him very well without the child support my child is six now, the money isnt important to me. He has had no contact in almost 3 years. He just went in and filed an income withholding form and i recieved a payment recently, the only payment he has ever made. My fiance and I are getting married soon and he has been my childs father since my child was 15mths. old. My child does not know who the ex is at all. My fiance wants to adopt him and we are going to go to a lawyer to get my ex-husbands rights taken away and have him sign papers to let my fiance adopt him after we are married. I know by the law in my state he doesn't have to sign his rights over to make this happen due to his neglect and abandonement of my child it is not necessary to have him sign just takes longer . Any information would be helpful.

Courts can not force a father to give up his parental rights, but your finace has been the child's father and it seems your ex doesn't want to be one. As long as the money is owed to you--you have every right to 'forgive' the debt. It's done all the time.

Generally in cases like yours the court does allow the removal of a persons rights -however if you can get him to agree with it, then the court proceedings will go faster. Once your fiance adopts the child your ex will not owe any more child support but will still owe the back 10,000.You can ask the court to remove that debt but most of time the answer is No.
