My ex-husband owes about 10,000 in back child support. He has had no contact in almost 3 years. He just went in and filed an income withholding form and i recieved a payment recently, the only payment he has ever made. My fiance and I are getting married soon and he has been my childs father since my child was 15mths. old. My child does not know who the ex is at all. My fiance wants to adopt him and we are going to go to a lawyer to get my ex-husbands rights taken away and have him sign papers to let my fiance adopt him after we are married. I know by the law in my state he doesn't have to sign his rights over to make this happen due to his neglect and abandonement of my child it is not necessary to have him sign just takes longer . Any information would be helpful. Thank you

I wouldnt lie about support payments and you cant send them through anything but the bcse so you cant lie about them either. I just wanted to know if legally i would have to cash them because i really have no need for them he has already paid through them so he isnt going to get in trouble well more trouble i didnt go after him for support he came to their office on his own out of nowhere he hasnt paid or taken care of the my child since he was 15 mths old . my child is 6. he has no visitation. If he does he gets supervised it is in my divorce papers. Very bad history of domestic violence. And yes as i said before I am going to see a lawyer. Just wanted to see and get stories from other people to see what they have went through and maybe they will have something i havent thought of asking or doing to discuss with my lawyer. You can never have to much information. no matter where it comes from . thank you all for your answers and i appreciate it greatly.tc n gl.

Follow the laws regarding adoption in your area so that there will be no irregularities in the documentation in order that your ex-husband will have no valid ground to claim the child.

My ex owes over $26,000 and has no contact with MY twins that will be 15 in June. He was actually found guilty of criminal non-support in my state and long story short he has started paying monthly for the past 3 months. I cash every single check I receive because my husband and myself have paid for everything for the kids for more then 12 years now. I would cash every check he sends until you actually have the kids adopted by their "father"

CASH THEM,CASH THEM, CASH THEM. Then go the adoption route. You & your child deserve it. Once the adoption goes through he will no longer have to pay anyways, or as an incentive to get him to sign the adoption papers have it written in that all arrears are forgiven. He'll sign them in a heart beat. Good luck.

There are different regulations in different jurisdictions, so instead of getting a hodge podge of 'advice' from people who don't even know where your place of residence is, why not talk to a lawyer and get good advice that is pertinent to your situation and your state. This is too important a matter for you to rely on information that might be unreliable.

YOU DON'T HAVE TO CASH THE CHECKS. IT WILL BE MONEY UP IN THE AIR.

IF YOU DON'T HAVE A NEED FOR THE MONEY, CASH IT AND DONATE TO MY CAUSE. I AM WITH MY BABY DADDY AND WE ARE BOTH STRUGGLING WITH OUR 8MONTH OLD DAUGHTER. SO DONATE IT TO A STRUGGLING FAMILY LIKE MINE

Even if you don't cash the checks you would be committing fraud and lying if you have received checks but just aren't cashing them.
