Technically the shop-keeper cannot charge you for any thing which you have not purchased or any service you have not availed, but this matter is so small that for mere few rupees going to the consumer forum or court is not advisable. Just to inform you that the number of cases pending in consumer forum are much larger then that are pending in any civil court in India & due to their high number the matter such as your can take few months or even a year to decide & the maximum compensation the you will be able to get will be only few rupees if the case is decided in your favor, but as compared to this the time, money you will be spending in this case will be much more then the compensation you get. Rest is your choice.

The Shop keeper is selling the magazine and is not lending the magazine, on payment. When, you have no intention to purchase the magazine, you need not pay the cost of it. You ought to have resisted it. But, you bought peace, like most of us do, by paying. I feel sorry for you. In a country where there is rule of law, such things should not happen.

It is Dadagiri. Govt. has 1 law, businessman, Lala has 2 la, 2 laws. Shopkeeper should issue bill to reader and reader can go to reader of Court.
Shopkeepr may be right. It is 50:50. For going to Court, you or your daughter will have to read 50% from 50 books on law.

Well, technically they can bill you. Your daughter consumed a service....by reading the magazine. If she were to eat 1/2 a cupcake in the check out line, you would still be billed for her consumption of that product. Reading a magazine not paid for is no different. She consumed the product, she is responsible for payment of the service.

Your daughter was stealing from the shop keeper. He sells magazines for a living and you and your daughter steals his sale, his money that should go to feed his children and if she wants to read go to the library its free. Now his product is used and if others did the same then he will be out of business
You just taught your daughter how to steal.

If you pay for it you own it. No on has the right to charge for something you don't receive.
