I paid a security Guard in the mall I have a store in $265.00 to open me an ebay store in my name. He scammed me. He actually opened the store underneath his own and when I presented this to him and asked for him to refund my money I wasn't listing my items under his store he refused to give me my money back and made up a new story that he was my ebay manger and to get an attroney would cost more then I lost. Can any one help me? I do have a paper where i paid him but i don't have specifics for what is was for. I have taken a loss in this mall and my funds are very little. Where should I go to get help he has changed everything on the site to make him look good. Is there a way I can get the orignal setting of the store he posted on ebay 3 weeks ago now that he changed it? Please help me

You could try complaining to ebay, I don't know if it would help or not, I doubt they would be too happy about someone scamming people like that, and may be likely to suspend his account, if you can prove that the deal was for him to set up the acocunt for you in your name, as opposed to selling things for you, that is not an unusual practice on ebay for people to list things for others. If you don't have a contract that spells out what his responsibilites were supposed to be though, I don't see much in the way of a successful resolution, either with ebay, or in a small claims court, but you could try small claims, and ask for court costs as part of the award as well as your refund.

You may want to look into your local small claims court. Attorneys not required. One caveat: you may be successful in getting a judgment in your favor, but it will likely be your responsibility to collect the judgment from the debtor.

Still worth checking out.
