In Texas, you can petition for divorce, but the divorce will not be finalized until 90 days after the child is born. Also, since you are still legally married, you will be the presumed father of the child on the way. You will have to ensure that paternity is established stating that you are not the father.

Actually, you might come out on top just because she is pregnant and living with someone else. You two aren't divorced yet, and though you are separated, she still could be looked upon as commiting adultery because you two aren't lawfully divorced yet. I don't see why you would have to wait until after, except maybe the stress from the divorce may affect her, thus affecting the baby. The stress can cause premature contractions and/or labor, so that may be the only reason why you were advised to wait.

What a mess this whole situation is. I suggest that you suggest that your son and his wife get some counseling and get matters straight. Don't make any sudden moves and think of the outcome before engaging in anything... Not true. If you dont get a divorce, you will be found legally responsible for her child and end up paying child support. Just go file and get it over with.

just to be safe have dna done on both kids if you watch maury povich you'ld relise that a lot of kids don't belong to the husband anyway.if they don't belong to you,you don't pay child support

that is ridiculous. you can get a divorce at anytime it doesn't matter if the woman is pregnant with his or your child. by the way... it probably was not just him that got her pregnant.
