Taking his last name will not cause the IRS to take your money to pay his child support. If you file jointly they will be able to take it. You will probably just have to file married filing separate to avoid that. (That is how my mom and her husband do it) His refund goes to child support and her's gets directly deposited in her account.

well your name does not mean a whole lot its the marriage thing that kilss ya. if he has to pay child support on a weekly basis no there not going to take it out of your check also. but if he is a few thousand behind and you file your taxes as a married couple then the irs could take your tax return money to go towards the back child support. none of this however has anything to do with what you want to call yourself concerning your last name

We are going through this right now in a very strange way. My husband has the same name as a man who owes child support and the IRS has taken his money. We had to file a claim to the money.
When we got the paperwork in the mail, there was a separate area for me to file to claim my half of the taxes (even if he really was the deadbeat dad.) So, it looks like they will take the whole thing, but that you can petition for your half.

If you file married what ever refund you get might go to help pay the child support, if he's not paying every month or owes back support. But if he's paying everymonth, then no worries there. It's not expected to come out of your check every month for the child support. The government doesn't see people with names, you are a ss number.

It has nothing to do with your name, it has everything to do with your tax filing status. Depending on what state you live in, they may be able to take your tax return simply because you are married to him. Most of the time, if you file "married - filing separately" they will not.
You need to speak with a tax professional to ensure the status of your return, but worry not about changing your last name.

If you take his last name the IRS will take your money as well as his to pay all delinquent money owed by the both of you.

yes they will!! I know of several couples that married and they used their own last names. but with that said ,if you put your names on contracts tegether such as morgages,autos,boats, things that a married couple might buy. Your best bet is not to marry and live together and address yourselfs as seperate ''entitys'' to the government. you then can own things together and creditors can only come after ''his'' interest in anything, but they can't force him to liquidate any assets if your name is on them also, they can only touch it after you sell your assets, and then they only can touch his percentage of the assets, not yours.

It isn't your name that will cause this...it's filing jointly. And yes, if he owes money, the refund check will be sent to help cover it.
