it depends on what the contract says. most the time the record company wants the rights but if the artist is smart, he gets the rights to the songs.

the copyright is with the original author of the lyrics and the original composer of the music. they can sign contracts to assign rights to other parties, usually a publishing company, and rarely a record label. the rights can be split up so that different entities can hold rights for certain purposes or in different countries. sometimes the rights holders are not current with the copyright office and can be impossible to determine unless contracts can be produced.
