Common law rights are found in past case decisions....i.e. where a judge decided on a case and at the same time set a legal precedent, this is commonly known as case law or stare decisis.

Statutory rights are found in legislative statutes written by local, county, state, and national legislatures. These are the laws 'on the books' if you will.

It depends on how you are using it, I think that national laws would trump state laws and common laws are different in many states. I am not sure I will be waiting to see if anyone gives any good answers to this question. One could probably find this by looking it up on this internet.
