The bill of sale isnt that important here if it was sold properly and legally, did she sign the title over to him, ? if so and he signed the check /gave her the cash then the smog test is his personal problem. not hers. best my knowledge its not a lemon law on a individual used car sale. only way he could use lemon law etc. would be a series of problems on a new car bought at a dealership, but on a used car/ from a individual, its as is . have to face it. used means used. its not a new car what else does he expect..

Proper spelling would make this question a lot easier to understand. Did she get the money for the sale of car? Did she also have ownership papers for the car? If yes to both then passing the smog test is now his problem. If she did not have ownership papers in the first place, then she could not sell him the car and will have to prove that she was not in possession of stolen goods. So, if she has the money, forget everything. If she has no money and no ownership, it's time to leave the state.

The so-called "Lemon Law" applies only to vehicles purchased new from a dealership that have had to have been repaired for the same problem more than three times.

Used, or "Third Party" vehicles are specifically exempt from that law.

Why on Earth would anyone release title of a vehicle without a bill of sale?

Welcome to the real world. Your "friend" was rooked.
