My car costs per year are approx. $3200 not including gas. I can't claim this on my taxes because it is not more than 2% of my adjusted gross income.

Are you self employed or employed by the company as an employee? you agreed to this arragement so yes it is legal is it a good deal for you no. My employer use to pay me 2.32 per day and mileage of .31 cents per mile five years ago before gas was outrageous and part of my insurance( the difference if I did not use my car for work.) SO you are getting a raw deal. But if you are self employed you can right off all of your expenses, wear and tear on your car, oil changes, tires, maintenance, car washes, air freshner etc.... check with a tax person. That 2% of your adjusted gross is when you want to itemized. Get a tax professional to help you out

If you are an independent contractor and they give you a 1099 at years end showing your earnings, you can take mileage expenses on a Schedule C.. If you are an employee and receive a W2 showing your earnings, you are indeed getting screwed. Make other arrangements with them because you are actually being taxed on money you do not earn. Perfect example of why labor unions will make a come back, to protect employees.
