i got married in 2001, we hve not been living together for the
past 2 and a half yrs as my husband is in jail. I would like to knw how do i go abt getting a divorce as i do not want this relationship anymore. From wht i hve heard whn u r separated for a while u r automatically divorced...is it true. I really need help with this

nope you will need to file for divorce, but the good news is that your mandatory 1yr sep per some state law is finished, if you live in the US.
Not knowing what country you live in, this makes a big difference as to what answer you will get.
Call the court house, i am sure they can tell you the procedure and what papers to file.

There is no such thing as an automatic divorce who ever told you that it is a moron. You will still have to file for a divorce. I suggest you contact a lawyer and advise him with the particulars but still you have to file the paper work for divorce proceedings to start.

You need to contact a lawyer!! If you cant afford one ,you can go to your nearest legal aid lawyer.
You have heard wrong as far as once you are separated awhile you are automatically divorced.
I wish that were true! Your husband will have to be sent the proper papers as well. So good luck & I hope it goes well for you & good luck on your new life by the sounds of things you need more!

No way. You will have to file for a legal divorce in court. He will be served his papers and so much time to respond. If he choses not to do anything you will be awarded everything you want at the court date. But you must file for divorce for it to happen. Use his prison time as the excuse. Good luck

In some states, divorce is permitted in cases of incarceration of a spouse. Check your state divorce laws. Consult a lawyer, or better yet, search the divorce laws of your state on the Internet.

Nope. You gotta file the paperwork. Talk to a lawyer. If you don't have kids or any shared assets it will be really easy. If you do, it can still be done but it is more complicated.

A law clerk will be able to tell you exactly what you need.

You will still need a divorce. call your local protonatary's office and they'll tell you all you need to do from a process perspective and would probably be willing to answer a few additional questions.

Because he is in jail, consult with an attorney...they will give you all the advise you need.
