My NYC landlord is making me remove mine, but I think his claim is untrue. I see plants kept on fire escapes all over the city. I am not blocking the window or the ladder.

I don't know... I never thought about it before... but now that you mention it, it does make sense. What if there were a fire and people needed to get down in a hurry?

My experience escaping burning buildings (twice in my life) has proved to me that escaping from an actual fire is NEVER quite as calm and orderly as "planning the escape" or as in "fire drills."

It does sound like your landlord is a conscientious person... thinking about his tenants, as well as possible lawsuits on himself if the plants did cause a problem...

This type of a law would be unique to your state or city. Laws vary by jurisdiction, but I can see where a local government might be concerned about safety and keeping access routes like fire escapes clear of obstructions. If you want a definitive answer, consult a local attorney.

As a practical matter, you should look at your lease. You probably did not rent the fire escape. Therefore, the landlord is probably responsible to maintain and control this area and probably has the right to tell you to remove the plants regardless of what the law says on the subject.
