Is this a real-life case? I am not sure. But, the man is still responsible for 2 deaths. The woman could have changed her mind about the abortion before she went in for the procedure. Again, it's about the woman's right to choose--not the man's.

No this is not only seen homicide if the ladies human beings needs the toddler i'd say this is seen homicide besides on account that unborn toddler would of had a raffle to stay, even if if the ladies human beings does not desire the toddler it ought to of being post for adoption while born (speaking approximately double homicide right here) As for abortion this is not technically classed as homicide because of the fact at that factor the fetus isn't unquestionably classed as alive while performed legally. even if if some human beings ought to strongly disagree with that.

That is the best question we have had in a long time- it is true by the way it would be double homicide. I heard about a woman who was stabbed in the stomach and both her and the baby died, and it was double murder. Also a woman was in a car pool lane and testified she was pregnant and guess what they let her off because technically there were 2 people in the car. That child is living from the time of conception- a blob of tissue does not have a heartbeat at 3 weeks after conception. You know why it acceptable, in the eyes of society? Because it is choice. that woman did not choose to be hit by a car. I know that logic isn't good- for people who think it is are not really using logic, they are using their selfish motives to "say abortion is fine" - Just because something is legal it is not always right. Interesting- thanks for your great question- I have asked this same similar question- so I pray that some of the responses aren't sarcastic. If people really thought about your question maybe more babies would be alive today.

First of all it is illegal I'm pretty sure to have an abortion after 20 some odd weeks, which ironically is around the time courts in some states consider it murder when someone kills a woman who is pregnant. If she is ten weeks pregnant and on her way to have an abortion, and gets killed in a car accident on the way, I do not believe the person at fault would get charged with the babies death as well.
It is arguments like this that don't seem logical, and usually aren't, that are used to inflame people on sensitive topics, especially ones as sensitive as abortion.

People who work toward making abortion illegal might try to charge and gain a conviction of murder in cases where an unborn child is killed or caused to die - no mater car accident, physical violence, etc. - in an effort to create the kind of simple question you posed... maybe they could get heard by the Supreme Court. As far as I know, these tactics have not been very successful except for laws that criminalize women for smoking/drinking/doing drugs while pregnant.

hmmmm. I guess because he should have been more careful, and because he was not intending to kill 2 people. She was intending to kill her unborn baby, and that is legal..if done legal and at the right stage. Speaking of stage...I don't understand how he was charged with double when abortion is supposed to be done in early stages right? Don't they do abortions before doctors really call the baby a baby? Ok, I am confused as well. Was he drunk? That should be the only reason he was charged with a homicide in the first place. I would think he would get charged with second degree manslaughter..or just manslaughter or whatever that is. hmmm

I'm not familiar with that scenario. But I know that if someone knows a woman is pregnant and intentionally kills mother and baby they will get charged with two counts of murder. But I was under the impression that if the perpetrator does not know about the pregnancy then they are not charged with that death. Its certainly possible that laws have changed since the last time I checked.
But your scenario would fall under the "my body, my choice" argument. You could choose to have your arm amputated if you wanted to because its your body, but if you lost it in a car accident caused by someone else they would be charged with a crime.

I get what you're saying. Unfortunately, it all comes down to the idea that the mother has the right to terminate the pregnancy, but no one else does. If it's considered murder if another person kills an unborn baby, but it's not when the pregnant woman decides to have an abortion, the governent is sending mixed messages. Do they believe a fetus is alive and a person or NOT?

Depending on the state, a baby has to be at a certain gestational 'age' before someone could be charged with homicide, and this age usually does not encompass the first trimester. In most states, abortion is only legal during the first trimester. Therefore, your hypothetical situation isn't possible.

Because many people in this world feel that children are not real people until they are born. So that's how the law is written. When I was pregnant I had an ultrasound at 12 weeks, and my little boy was moving around and wiggling his body. Maybe it was because he looked more like an alien than a person at the time...I've never seen anybody prosecuted for murdering an alien before.
