I have to go to court for unpaid medical bills. I have no insurance, I have not had the $$ to pay! They want almost 70,000. I am currantly not working,due to my injuries from a wreck. (separate from this bill..that one's taken care of at least!)
Have 3 kids, and my spouse,barely works full-time,and by payday,we are out of $$
ANY ADVICE??What will happen when we go?We have to appear,we didn't the last time.-----This suxxxx !!!!

File bankruptcy. I believe there is a way to file just on medical bills. Consult an attorney.

First of all, show up for the hearing.

Secondly, if you were injured in an accident that was not your fault, get a personal injury lawyer on board. Recovery of medical bills, pain and suffering, and lost wages is what they do for people. The medical creditors can be paid out of any settlement.

Thirdly, you may consider filing a Chapter 13 Bankruptcy (Wage Earner Plan), where you would end up paying back a portion of the amount owed. You will need a lawyer for this. I don't like the idea of recommending pro se bankruptcy filings.

Do not back out on this! You need to go and prove your case. If you can show that you have no way of paying the bills, the judge can force the creditors to negotiate.

If you don't go, there will be a default judgment against you, and the only way to get out of that is to file bankruptcy. Either way, your credit will be ruined for the next ten years.

Take paychecks, bank statements, taxes...whatever you can find to show how low your income is. They can't squeeze blood from a turnip, but they will try. It is important to show up to try to prove your case. The judge will take your financial state into consideration. If you don't show up, you are guaranteed to lose.

I hope you have a good reason for not appearing the first time. Judges don't like it when you fail to appear. I would imagine you are in small claims court and if so the judgment would only be the maximum allotted in your state, about $5,000. and from there you can make payment arrangements. This is not going to go away with out you paying something.

Go to court! The judge will not have an sympathy for you when you don't show up. Be honest and respectful. Tell the judge your side of the story and they will try their best to help you out if you are doing all you really can to pay back the bills.

Go to your local Legal Aid office and get some professional advice. There are protections - is there any liability in the wreck, ie can you sue someone else for medical damages? You need professional help, because trust me, the people you owe the money to will be represented by really good lawyers who do this all the time, and whose sole goal in life will be to bleed you dry.

The first thing you have to do is SHOW UP. You look much better by showing up with and saying you have no money than not showing up at all. Dress appropriately and explain your plight to the judge. The hospital should be able to work out some kind of payment plan with you. Let me know how it turns out.

Explain to them why you havent paid then try to apply for medicaid in also foodstamps so you will be able to save money on food and on insurance for the family they will understand your problem more if they see that you are actually trying to better your sitituation.
