There is this guy that I have never seen before. I can see him through my window. He is sitting in my patio. Is it legal to shoot him right away?

First, as to your course of action, it depends on which state you live in, however, no state will let you shoot first. In South Carolina, you can ask him to leave, and if he doesn't you can call the police and have him escorted from the property. However, if he grows violent or threatens you in anyway, then you may take steps to defend yourself and your property. If he then threatens you to the point that you feel your life or the life of a family member is in imminent danger, you may use lethal force. Then the law will show up, charge you with murder, and attempt to sort out the facts and hopefully clear you.

You have no right to shoot somebody for sitting on your patio. If you see him on your patio, call the police.

If an individual breaks into your house for the purpose of committing a felony therein, you have the right to defend yourself and your family.

No...you can never use deadly force to protect property in any state...you must feel threatned to use deadly force. If he were in your house and gave you the indication he was going to harm you or your family...fire away...but if he is just watching the tv or sitting on the poarch you will be charged with 2nd degree homicide or manslaughter. Deadly force protects life not property...or prevents trespassing

Do you live in a Make My Day State? If you can see him then you can certainly call the authorities and stop looking for an excuse to murder.

Ooh...call the police, I don't think you can shoot him unless he tries to come in your house. Even then he has to be "in" your house. That's what the cops told us when my sister had a stalker last year.
