nope, that would be manslaughter. If the victim dies of complications from those injuries however, involuntary manslaughter may be contested if the judge allows it based on the case. However, battery and possibly assault charges are in play no matter what happens.

No, because the action was intended harm in the first place, so you knew there would be something internal going on that could create a death while beating the person.

That always goes through the back of someone's mind when they are punching and kicking someone, but unfortunately our court systems call it manslaughter and get someone off for less time.

It is not an accident if punching or kicking is repeated. Only if the person dies as a result of one punch or kick at a sensitive spot, it is an accident

manslaughter is the term for accidental or unintentional death. And whether it is in fact an accident depends on who started it. If it was self defense then again manslaughter would be used but could be reduced or changed depending on out come in court. If the person who started it finished it then it could be second or first degree murder and not considered an accident.

I believe it depends on the intent of the attacker. It`s certainly an assault, but if someone were punched in the stomach and died 2 days later from internal bleeding, it would probably be charged as manslaughter, or negligent homicide.

No,an accident is something that happens unexpectedly and unintentionally-but if someone has been bashed to death then it is no accident,kicking and punching are intented to hurt and harm. so, it cant be unintentional that it resulted in harm,damage and or even death-therefore, however unfortunate the incident, the intention to harm was there

It is only an accident if the action of punching/ kicking can be proven as involuntary somehow involuntary. If not, you are looking at manslaughter.

Manslaughter at the very least. But sounds fishy if it was BOTH punched n kicked..seems like great harm was intended.

It depends if it was intentional or not.
If it can be proven there was intent to harm then it's murder, if there was no intent to kill them (like some bouncers and stuff do it to break up fights, etc or in self defence, etc) then it's manslaughter. Both are chargeable offences.
Manslaughter would be an accidental death, yes.

well, i knew someone in my old school that got killed in a fight.He was born with a brin problem and the docters had to take out a pice of his brain. He still was living a normal life as a kid. A day came that a kid just punced him in the face for wutever reson. he was in the hospital for a day dand died. After wards, the court found a way to bust the kid who punced him and have him sent to jail.\

So if thats wut you meant, yes you would get in trouble
