They picked Leonard Peltier as the guy to pin the killings on and call them murders, even though everyone else in the case got off with the "justified self defense" plea. The FBI covered up evidence and misdirected the jury, and now even the federal judges who sat on the case now say they have problems with how the government conducted the trial. Not that this answers your question, but:

The evidence used by the FBI at several points during their investigation have been proven to be false.

All of the people who gave statements in which they stated they spoke to Mr. Peltier after the incident and he had confessed to them, or that stated that they had seen him commit the crime, have recanted their statements claiming they were coerced by the FBI into making the statements.

Independent investigations into the matter -- as well as investigations conducted by the FBI -- have proven that most of the statements were given by people who did not know -- nor had ever even met -- Mr. Peltier.

This includes the statement taken which allowed the FBI to extradite Mr. Peltier from Canada. It has been proven that the woman who gave the statement lied to the FBI. She claimed to have been his girlfriend and was there during the shoot-out and the murders. However, it has been proven that she had never met Mr. Peltier nor was she even present during the shoot-out, let alone present during the murders. She too, claimed that she had been coerced by the FBI.

The other two defendents in the case were both found not guilty -- even though the evidence used against Mr. Peltier was also used against them. The jury even went so far as to state that the gun battle that had acted as a "pre-cursor" to the murder of the FBI agents had been an act of self-defense on the part of the Native American's involved.

Add to that the following:

Today, the United States Attorney admits that no one knows who fired the fatal shots.

Ballistics evidence was withheld from the Defense during the trial. Not only that, but the Prosecutions witness who claimed that he'd been unable to conduct a firing pin test on Mr. Peltiers weapon, but had conducted another test that showed it was the same weapon, lied on the stand. Documents released through the Freedom of Information Act showed that the expert had indeed conducted the firing pin test which had shown that Mr. Peltiers weapon was not a match to the rounds that killed the Agents.

At the Peltier trial the Prosecutor claimed in summation that...."we proved that he went down to the bodies and executed those two young men at point blank range...". At the appellate hearing, the government attorney conceded "We had a murder, we had numerous shooters, we do not know who specifically fired what killing shots...we do not know, quote unquote, who shot the agents."

If nothing else, he deserves a new trial.

Because Leonard Peltier was the wrong NDN in the wrong place at the wrong time. The FBI has an extensive history of railroading native americans for crimes that they didn't commit. Some of them are in with local tribal officials who only wish to better things for themselves and others are just plain racist. You will find that most of the people on this site will side with the feds because they aren't from the rez, have never been to the rez except to gamble, and have no idea about rez life and rez politics. They see the world from the comfort of a suburban living room and think the indians on t.v. are the real deal. They know nothing about tribal unemployment, leading many natives to leave the rez in search of jobs. They know nothing of tribal corruption, where tribal officials are stealing the casino money and the feds do nothing. Go figure.

The FBI can misdirect a jury, a prosecutor can do that though, that's their job. If the presiding Judges on the panel had a problem, then why didn't they say so?
