Both of my parents past away in 1997 in Nevada. I have five siblings one of which was instructed to give my two children the money they have put in a money market and others monies through insurance, retirement, and more that I am not sure of as I do not know the name of the lawayer my Mother had hired. My Father died first then my Mother followed eight months later. I am also not sure the will was finished. She did have a living will. All in my imediate family new of thier wishes by verbaly expressing so. Now my Brother who played executor, said their is no money. My children have reached twenty one plus now and are wondering what went wrong. How could their Uncle do such a thing. We would like justice and some kind of details of where an estimated $58,000.00 went to. Thankx for any help anyone can offer me. Thank you !

You could try searching for records through the probate Court, but you may not be able to find the details that you are looking for.

Mary - I feel for you - Join the 'club'! My mother died October 2004 - 11 days after her 89th birthday! She on the West Coast - I live on the East Coast - So did all of my brothers and sisters - who all lost thier lives in September 2004. My mother cancelled her will the end of October and went comatost one day she had the appointment to get her new will which was going to leave her estate with 'me' since my father died in 1977 and all of my brothers and sisters where dead. She did do a 'letter - note' that everything goes to 'Jane'. That is helping to a point - but, She owned both commercial and residential real estate in nine states! It is extremely complicated! I have an Attorney in California who is 'Trying' (and, Working EXTREMELY HARD!). I'm to the point - I'm not really expecting anything if anything maybe some commercial real estate that I have signed paperwork on - it's scary! I Really think that I personally might be more scared of recieving it - the amount is HUGE! I would have a monthly income like I've never had before! I think I might be better off without it. I don't know - I'm leaving it up to the Lord and I'm letting it (whatever) happen in His time. I wish you the Best in your endenvor! God Be With You!

I don't want to sound mean, but why are you waiting until now to do something about this? If there was no written document specifing your parents wishes then the he said, she said thing is all heresay, as far as a court is concerned. You could try to obtain an attorney to determine what exactly happened but unless you have the means to do this, what would it really accomplish except for more hard feelings. A living will has nothing to do with one's estate. If your brother appointed himself executor was their an estate to be handled and was a court involved? If so, then you may be able to prove that fraud was used to obtain funds that did not belong to him. I do think that I would at least go and talk to a family attorney and get your options. As far as your statement of "How could their Uncle do such a thing"? It is easy, it is called GREED!! It happens in every family. I am very sorry for your loss and that you all are having to go through such an awful thing. I do hope things work out for all.

Look in the Probate court records for that County/district in Nevada. They may even be online. You can at least find the contact information for the Probate court for that district at:
