i had to have an emergency c section because the baby's heartbeat slown down so bad. the surgeon cut my baby's cheek bone, very close to his left eye. the doc said because i had no water in my uetrus! he said i must have lost it gradually. also he said the baby won't have a scar. imy son is almost 8 weeks and i still see the cut even if it's healed. the doc was nice and i was nice too and didn't complain. is what i did fine or i should have complained? is his mistake acceptable? please give me your opinons specially doctors. thanks

i never thought about taking him to court.that doctor is about 60 or more and wouldn't want to do such a thing to a man his age, but the question is: what if he cut my baby's eye? he should have know i lost my water? i don't know if that's possible or not! it's not the money i'm looking for. i just needed to find out if it's ok to make such mistake. we are in the USA, biggest country in the world, where you pay big bucs to go to med schools.

I am very sorry to hear about this, but at least your son is alive. Eight weeks is very early to be worrying about whether the scar will disappear or not - if the doctor says it will, then why not believe him - he is supposed to be an expert.

You could sue the guy - but what would you gain from that other than (possibly) some cash. You could lose the case and end up with nothing.

It won't change anything for you or your baby, but what it will do is to jeopardise the career of someone who rescued your baby's life.

I can't agree with the answer above that you need to do something so that it doesn't happen again - does this person really believe that the surgeon is incompetent on the basis of one event? The important word here is "emergency", surely the doctor was rushing to save your baby's life, if he'd gone slower could he not have risked losing him?

Please people - let's move away from trying to sue the backside off everyone who makes a mistake. It will get to the stage where nobody will do anything because we are all too scared of being taken to court.

You can try to take him to court but you won't have a case. He cannot be sued for malpractice because he did nothing wrong. It sounds to me like your baby would have died if they didn't get it out in time and if there was not adequate water and time was of essence then that is probably not the worse thing that could have happened. When you sign the release form to have a c-section these kinds of things are what it covers (if you actually read it instead of just signing it). It is very hard to win a malpractice case and this is definitley not malpractice.

NO there is no way to know this kind of VITAL information when doing an emergency c-section. They don't have time to hook you up to a sonogram to find that out...hence the word EMERGENCY. I work in the OR and see tons of emergency c-sections come through our doors plus I had one of my own and their first concern is just getting the baby out.

I'm sorry about all you went through with this. I too had to have an emergency csection, it is no fun. I'm also sorry that your baby was born with a boo-boo. I dont think there is much good to be done of complaining about it though. It will heal. And I dont think you would find a lawyer to take the case to do much about it since in the grand scheme of things, it wont be considered permanent damage. if it leaves a scar, it will be funny one day because it will be somewhere completly different on his body. funny how that happens when their little skin starts to grow and move. Just be happy that the doctor didnt waste valuable time in deciding that the csection was neccisary. Had he have, you might have much worse problems than a cut on his cheek. Congrats on that little tot!

If the doc said that it was because there was no water in your uterus then that is probably why it had happened. I have heard of a lot of my friends having c-sections and that kind of thing had never happened to any of them. My sis had 2 c-sections and both of her kids came out fine. If your kid came out healthy then I wouldn't worry about anything. Does everyone see the cut area or is it just you? Maybe you can still see it cause you knew what happened and it just stands out to you. Maybe others don't notice it because it is barely there.

I know a girl who was cut same as your son and she is 30 and has the scar to prove it. You know sometimes these things just happen. If you truly believe that the doctor wasn't negligent which it sounds like he wasn't, then just let it go. I know its hard, but there are so many stupid law suits these days that we have to pay for it with higher med bills and ins. Best of Luck

I think the doctor's answer sounds more like a cover-up for a mistake. There are many ways to tell how much fluid the baby is surrounded in, and before a major surgery, this info is VITAL!!!
There is no way he could not have known that bit of information. I would seek legal counsel. Even if your baby heals perfectly (which I hope he does) he could have cut his eye! Furthermore, what about the next baby he delivers???

Better a small scar then a dead baby. This is why malpractice insurance is so high and people are not going into obstetrics. I am sorry that your baby will have a small scar. In the big picture of life is it really that big of a deal?

I don't have a baby, but I would be very upset. I'm sure this is considered as a "mistake" but I would not want my child to have a scar if possible... maybe you should go to the doctor or call him and ask him when it will be healed, because you still see the cut. Sometimes children do not mind about their scars, but other times, they will become very sensitive about it.

I have heard things like that happen in rare cases. I don't think you should be mad at the doctor because after all it was an emergency situation and he had to react fast for the safety of your baby. However I would be upset. Your sons scar will most likely go away as time passes.
