The judicial branch has a CRUCIAL role in the lawmaking process; while the congress is expected to account for the majority of their constituents and enacting laws that most accurately describes their wants and needs, the judicial system is responsible for CHECKING AND BALANCING these laws. This means, if Congress fails to consider a problem in the light of an individual case, as the courts are presented with, and if, somehow, individual rights and freedoms are dismissed based upon existing laws, it is the DUTY of the courts to protect the freedoms of the person and their rights through repeal of laws that produce Unconsitutional or unethical ends.
