can you file the lawsuit based on the provision of the contract stating only mere hypothetical warranty? meaning in case you think that some of these warranty is broken?

what? a hypothetical warranty. either you have a warranty or not. either the product is broken or not. if you think the product is broken, that won't be enough, it has to be broken.

Your question doesn't make too much sense because I don't know what you mean by a 'mere hypothetical warranty". You can only file a lawsuit if there has been an actual or threatened breach of the contract.

If you have a warranty and the seller or manufacturer refuse to honor it, then you might have a claim.
