There may be something in there to address your question, but when it comes down to it, I would assume that the person in question would opt for some sort of confinement..which is not exactly humane, or desired, but it would seem prision would be especailly hard for someone who was intersexed.

FYI: No such thing as a human hermaphrodite.

A hermaphrodite is being FULLY male *and* FULLY female.

The correct term you are looking for is intersexual. An intersexed person is male and female.

Also, gender is a social meaning.

The intersexed person may be biologically both sexes (male and female), but most likely feels mentally to be more-so one of the two sexes, and thus would be sent to the prison that is appropriate to those feelings.

If they have male bits they go to a special section of male prison (apparently)

a male prison, even pre-op transsexuals are sent to male prisons. as long as you have a penis that's where you will go. obviously there would have to be a solitary confinement of the individual for their own safety.
