I am 4 months prenant and we arent speaking. He doesnt want anything to do with me. I need to collect child support so I would like him to be on the birth certificate, but I dont think he will sign it just to make me mad.

Most generally, to put them on the birth certificate they have to sign it. But if he's refusing to sign it, then you can take him to court for child support and he can either voluntarily agree that he is the father or they will order a DNA test. Either way, if he is the father he will pay.

When I had my kids 14 and 16 years ago, the father had to sign the birth certificate in order for his name to appear on it. The voluntary signing of the birth certificate is the father's way of saying I know this is my child. Now I was told you can file for child support but to get child support money, a blood test will need to be done to confirm the biological father and once the father is established then the order for child support goes in.

You can't add him. He would have to show his ID and sign the birth certificate. If he doesn't or won't then after the baby is born you can take him to court and make him pay for the paternity test and get the child support money. But also keep in mind that he may request visitation. Good Luck

Bethany and Heather have it right. If not married, the dad must either acknowledge paternity by affidavit, or submit to DNA tests, which is actually safer for both you and him. You can apply for AFDC once the child is born, and the public aid department will go after him for support, if you have not brought your own paternity suit.

He does not have to sign anything, and mostly the hospital is not authorized to name a father, just on your sayso. What if you claimed Brad Pitt as the father? Birth Certificates are only evidence of birth circumstances, not paternity. So even if you somehow got his name there, it would mean nothing.

If you are married then he is automatically assumed to be the father and goes onto the birth certificate without signing anything. If you are not married there are two ways to have him identified as the father for legal purposes. The first is for him to sign an affidavit of paternity, asserting that he is the father. The second is through a chain of custody DNA test.

It sounds as though he won't sign the affidavit, so you will have to petition the court after the baby is born for the chain of custody DNA test to establish paternity. After that is done you will be able to seek child support. That will also allow him to seek custody or visitation--rights he would not have without being identified as the father.

Well it's not really up to him.. It most US states if you are not married they won't put him on the birth certificate without a paternity test anyway. But either way him not being on the birth certificate has nothing to do with child support... When the baby is born just go file for child support and they go from there.

It depends on the state. With my older children I wasn't married and I lived in Pennsylvania. The childrens' father did not have to sign the birth certificate.

What you can do, in order to find out what the rules are for your state is contact your state's (or county's) Bureau of Vital Statistics. If you type the phrase "Bureau of Vital Statistics" along with the name of your state (or county), you will be able to find the site that would be the most helpful. Once you get to the site, if you don't find your answers, you can look for a phone number under the "Contact Us" section.

Check with your state. In CA, if you are not married, the father must be present to put his name on the birth certificate. If you are not married and he does not want to be present, you then must have a paternity test done to prove he is the father and then you can start collecting child support.

He does not need to be on the birth certificate for you to get child support and I know in Missouri he does not have to sign the birth certificate for you to put his name on there.

His name does not have to be on the birth certificate but you can still get child support from him, a simple DNA test will prove it all, besides he's the one missing out.
