Here is a very interesting article that touches on just that topic:
http://jscms.jrn.columbia.edu/cns/2007-02-13/guzder-sugardaddies
The article talks about http://www.seekingarrangement.com
Its a Sugar Daddy dating site. In the article, the author says "Not even lawyers are sure how to answer that question"...
From my own personal point of view, I think there is a big difference between a prostitute and a Sugar Baby. A prostitute is a person who sells her body to any man who has money to pay. A Sugar Baby is selective, and usually only has one partner. A Sugar Daddy can be a husband, a secret lover, or just a companion. Sugar Daddy is just a wealthy guy who is willing to pamper his woman, and unfortunately in the world we live in, they usually do this with an expectation that they will get something in return -- usually companionship or sex. :P
A boyfriend expects his girlfriend to have sex with him, right? So, why does a Sugar Daddy who expects his Sugar Baby to have sex with him considered prostitution just because the guy has money and is willing to spend it on the girl?
I think the line is clear. Having a Sugar Daddy is what makes an independent woman smart! Why others want to call it prostitution is beyond my understanding, except to say they may be a tad bid jealous because they aren't rich enough to be a Sugar Daddy, or they are not beautiful enough to be a Sugar Baby .... ;-)

Why would I consider what to label someone that is living that life style? Its none of my business. If that is what a person wants to do, and they feel no shame, and both parties are OK with it.. then all the power to them.

I'm sure it's a matter of opinion. However there seems to be no law that can touch it. So, in that sence, no.
