My bf is 17 and wants to know if his mom has to sign the papers, and if she has to be present at the hearing?

Emancipation means one of two things.. turning of age, or showing a judge the said child is able/willing to care for himself. (not dependant on someon else) Meaning~ He would have to show he has a job, going to school, or graduated, showing he can financially support himself.
A parent does not just walk in and say I want him emancipated, he the parent does not want to said child then the parent and terminate their parental rights. Which means the child is placed in foster care.
I doubt that is what your boyfriend wants, why does he hold out and waiting till he turns 18, or get his parent/s to sign over guardianship to an adult.

Emancipation can take up to a year before it becomes official... i know i was looking into it when i was 17... so he should just wait. then if he wants he can fall off the face of the earth where he never has to see or hear from her again even if he just lives down the street..

She will have to be present, but the judge will determine the outcome... Based on the 17 year olds ability to support himself, etc.

Or he could just wait one more year and he doesn't have to pay a lawyer : P

Yes, she should be there. It is up to the Judge to have the final say.
