People do not go to jail for manslaughter or are even charged with it if they did not do something to cause the death. Sometimes the underlying offense is as minor as careless driving, but no one is charged with manslaughter unless they did something negligent. It may have been an accident, but the other person did something to cause the accident to occur.

Actually mansalughter is twofold...vonluntary and involuntary
n voluntary manslaughter the person did intend to kill the person and the intent is just mitigated down from murder due to circumstances.
A man who walks into his house to find his wife in bed with another man and he kills them is guilty of manslaughter...we all understand but he killed someone
Another example is a drunk driver...he didn't intend to kill anyone but his actions in getting drunk and then driving led to the deaths of innocents...how else can we punish them?

if we didn't jail the "accidentall murderers" then the defense of "it was an accident." would begin to make it easier for those with the intent to murder to get away with it. For example, if Mrs. A is really upset with Mr. B, she can get completely intoxicated and run him over. Because she was intoxicated, it could be proven to be an accident instead of on purpose. She could walk away scot-free. Besides, negligence is in fact a crime.

People who kill by accident should not go to jail. Jail is a place that should be intended to separate bad and evil people from society and people who kill by accident aren't bad people. People should be able to understand that people make mistakes.

Yes, but the manslaughter may have been avoided if they had been more responsible as in a Drunk Driver killing an innocent person.

Because ALOT of people who do are doing something stupid or illegal or dangerous to cause the "death" of the other person. Its only right to punish them for their foolishness, in my opinion.
