I got married in the year 2004 and stayed with my husband for 8 months in Netherlands. Over there I was staying in a joint family with my husband’s brother and his wife. My husband used to always be busy with his brother’s wife as he is strongly attached to her. Due to which he used to always ignore me and my needs. I have suffered a lot durin my stay with my husband.

Now, it has been 2 yrs since I am staying in my maternal house. My husband has not yet signed the marriage certificate and neither is he making the necessary papers that are supposed to be made according to the Dutch Embassy. My husband has come to India twice but every time he made excuses and did not take the initiative of signing the marriage certificate and making the necessary papers. He is wasting my time and always making false promises. I want to divorce my husband on grounds of cruelty and desertion. But my husband does not want to give me a divorce and I want to marry again. Please guide me what should I do?

According to which ceremonies/form you got married to your husband? As far I can presume it must be according to Hindu form of marriage. You did not have this marriage registered under section 8 of the Hindu marriage Act, 1955 hence you are not having valid marriage certificate which the Dutch Embassy requires you to furnish. Now you want divorce on the ground of cruelty & desertion of 2years from your husband, but your husband is not interested in divorce on mutual consent. Ok file a divorce case on these two grounds under section 13 of the HMA, from the place you are residing now. This whole process may take few years to decide then you can remarry after getting decree of divorce. For more guidance write to me directly.

Well, Acording to traditional marriages, so is the case that, u do not get legal marriage certificate. u have to either convert it or get court married again. but if u think that ur husband is cheating behind u, or has the intentions av not taking u along, so dear I think so u have 2 options left:
1. You contact a good lawyer (if u wanna get rid av him)
2. Is any1 near him that he really cares and listen too, that can talk to him and resolve the problem?

This is a complicated story. If you never had marriage certificate signed, in what country's eyes are you legally married? You are going to need an attorney to help sort this out. I wish you the best of luck. you do not deserve to be in this situation.

if he never signed the marriage certificate then you are not legally married so, you don't need a divorce
you can just move ahead with your life and leave this LOSER

The only thing I can suggest is to get a lawyer because it looks like your going to go through a contested divorce.

Dump him and make a big drama. Make his life hell. Find a nice guy and ditch him coz this man needs a kicking.

oh its terrible!!

but dont you think you are rushing too much ? did u talk to him aboutthis or are u going to take this sole decision to divorce him? atleast talk to your friends or why not talk to your husban'd brother and his wife about this? maybe you are misunderstanding him!!!
