well I think so I read somewhere that a father can claim maternity leave if he adopt a child

It is not "maternity" leave but FMLA Leave (Family Medical Leave Act) that is allowed by Federal Law. Any parent is allowed to take FMLA for adoption purposes. However, as an adoptive Mother, an employer is not required to give an adoptive parent "maternity" leave for adoption. I know because when my husband & I adopted, my employer refused to allow me to take maternity leave, which left me having to take UNPAID FMLA leave so I could only afford to take 2 weeks off when my child came home. It is a very unfair process for adoptive parents. A co-worker who gave birth the same week my son came home, was entitled to 12 weeks PAID maternity leave!

I should hope so. If a man/woman couple adopt a child they are both entitled to maternity and paternity leave.

I guess though that a guy/guy couple couldn't get 'maternity' leave, it would be 'paternity' cos he's a father not a mother Geddit?! LOL

For most companies, men are always allowed paternity leave to bond with the child. As gay marriage is approved in various states, company policy and state laws will have to adapt to be more family friendly.

There was an interesting article the other day about a lesbian who sued her company because they would not let her take paternity leave. I think she won, so based on this precedent, I would have thought that gay fathers have the same rights.

I would guess so, it might be a good idea so that the child gets used to the parents before both start working like crazy and leave it with the nanny.

Don't see why not, they're your children after all, they come into your life at a young age, just like regular children, so yeah I think they would.

I think it would be called Paternity leave. Men are already entitled to this if their partner has a baby so I don't see why it would be any different for a gay couple.

no but he could possibly claim paternity leave. This, however, is only for a few weeks and no where near as long as maternity leave is

Yes you can claim paternity leave, but I think it is kinda based onthe type of company you work for. I don't know if the law's changed on it but our company is quite modern so would allow the standard for gay couples etc etc to.

wouldn't have thought so, unless the child was really really young.. i guess it would make sense for one of them to have a little time off to look after the child.. but not as much as a child-bearing heterosexual mother has ( as it's true physical stress on her body that puts her out of work, not just the stress of bringing up a young child).

women its a different story, as they typically ( though not rightfully) earn less than males do ( particularly in business careers, such as insurance and the like). so they may be less able to afford child minders or the like, or be able to afford to give up work for a small while.
