I have remained a strong advocate of implementation of common civil code in India if not on all issues but at least on issue concerning marriage, divorce & maintenance. I know many of you will not agree with me because of religious beliefs, but when some real problem arise in your matrimonial life you all looking for its solution, & if by chance you come to know had there been a common matrimonial law with all the provisions that could have covered your matrimonial problem you would be better placed than what you are now. In India the government enacted The Special Marriage Act, 1954 that was a step towards the implementation of the common civil code, but unfortunately very few know about this enactment, even if you marry according to your religious rites & customs you can get your such a marriage register under this Act, benefit of this will be that after such a registration you can avail all the provisions of this Act. My question is what do you say about it?

I'm really impressed by the intellectual opinion that some of the members have expressed here, this shows the maturity of thinking we have in understanding the benefits of the common civil law. The courts in India have always emphasized on this concept for removal of indiscrimancies in the civil laws because of religion, caste, or sex but due to the political reasons it is not being implemented in our country, the fact is, had we implemented it long back in 1950s itself this situation would not have aggravated so much & become a political issue for the political parties now during election time.

I/We agree completely with your views/suggestions about implementing a common civil code in India,encompassing all the good points preached by different religions in India.

As time goes on, public opinion keeps changing in tune with modern ways of living and related issues of pressure,stress and strain.

Therefore,it is necessary to take stock of the situation periodically,in different walks of life and make amend as and when required ,with out standing on false prestige ,ego, religion etc to adopt the best methods and practices that would benefit community /society and humanity at large.

I strongly agree with your idea to go in for a common civil code but all the parties and religious groups concerned must take sincere interest in the common welfare of the people and should whole heartedly support the same.

I appreciate your interest in raising such an issue of vital interest for the benefit of the society,but political and religious groups should support the issue w/o promting the division among the people to keep vote bank politics alive and active for their own benefits.

I wish we succeed in our effort of mobilising support for such a cause and let us work for it with all sincerity.

I agree that there be a common civil code for marriage, divorce and maintenance and also bigamy should not be allowed. The divorce laws of the day, favour women too much to an extent, that all cases relating to separation and other problems within seven years of marriage, are treated as dowry cases. A few in the under literate areas may be reallly due to dowry cases. But many of these in cities and towns can be cited to, too much of indepence to the emancipated women not able to adjust as adjustments are considered as loss of individuality. laws hence should be neacted to be treated as common for all religions and on all the above aspects.

That is something I too have always been against the Indian Law Makers, just for the sake of a few elctoral vote banks these guys have made different laws for different religions - whihc clearly shows distinction between various religions - if we are talking of Democracy and equality we irrespective of being from which ever religion laws need to be common.

But the problem is our Law makers won't do it because all they care for is their seat of power.

Now recently another gimick for vote banks they have been comming up with different laws for different Genders!!! - the buggers are out of their minds!!

so long as that civil code is amendable the world... was a lot differant 53 years ago..woman have come a long way..if an Indian women comes to this country she isn't going to want to go back under the same conditions... any laws you make over there have to include the rights of the women

i totally agree with you as the present laws are more pro-women as a result guys in genuine distress are left hanging out, in todays times most of the laws are misused by the females for their own selfish motives as a result families are devastated.
