I asked a simliar question and that was regarding on the time frame to sue for back child support (No time limit in California). The main question I have now is the steps to sue. I contacted a Legal Aid but they are charging me $300 dallors. I then contacted a network that collects back child support but they want 35% of the money they collect. In California the Child Support Services is flooded with cases and won't help. Do I have to hire a lawyer or can I file it on my own....

If your child is over 18 they would have to sue. It is their money. My mother already went through this. i would have to sue my father.

Your child will probably have to file the suit since he is 18 now and the money would be the child's. You will have to have all the documentation as to when the child support was ordered, how much was paid and how many months it was not paid. If legal aid will handle it for $300 that is probably your best bet. Even if you get a judgment against the child's father, you may still may have a hard time collecting any money.

Present documents for non-payment and file a case for mandamus against the party at fault so that he will be ordered by the court to comply with the child support.
