Treason is still on the books as the offense that can result in a Death Sentence. To the best of my knowledge it has only been used once in the Roseburg spy case, but the law is still on the books. I have seen talk on this board about giving the death penalty for habitual child molesters or rapists, but no such law currently exists.

The only time a death penalty can be assessed is in the case of a murder and even that is not a high enough standard. The death penalty requires either multiple murders or a murder under special circumstances. These circumstances are usually limited to heinous crimes and when a police officer is killed. Usually, the only time the death penalty is offered, as a punishment is when the murder was a permeated one, or the result of a criminal spree or other such major events.

We are one of the few technology advanced governments that still has the death penalty on the books. Mexico, Canada, and many European countries refuse to extradite a criminal from their nation to the US unless the death penalty is not one of the proposed punishments.

I support the Death Penalty because in some rare cases it is necessary. People argue that the Death Penalty is not a deterrent to crime, but I think executed serial killer Ted Bundy can argue against that. He may have never considered the death penalty when he was killing people, but all of his killing has stopped with his death. At least one person was deterred. Serial Killers like John Wayne Gacy have told interviewers that they will return to their serial crime habits if they are ever released. So the only choice that society has to warehouse these people in expensive prisons. They can never be trusted to be released or to even work in society and they will never be contributing members of society. Sure a serial killer painted and others could write or create works of art and literature, but I don’t think that any of that would be worst the cost to society to keep the person alive or the risk that they will continue to pose until they are either killed or died.

The Death Penalty can be used as a deterrent. Supermax prisons hold the worst offenders, a lot of them are gang members and look at murder as a social or casual event. If given half a reason they will kill someone with no second thoughts. Once you have sentenced a person to more than one life term there is nothing else that you can do to them that will have a real effect on these hard-core criminals. The only thing stopping them from killing their fellow inmates would be the death penalty. They may laugh at it, but if they are found guilty of additional murders and if they are found worthy of the death penalty then at least that will stop them from continuing to kill.

States like Texas use the death penalty too often, there has to be a better way, but I still think we need to reserve the death penalty; as for using the death penalty for crimes of treason that will be harder to determine. If a jury finds that the death penalty is valid in this case, because the Treason resulted in the death of many individuals then it should be applied, but the Rosenberg’s were killed because their treason made it possible for the Soviet Union to kill millions of people, with nuclear weapons; something that hasn’t happened yet.
