You will have to have permission from the father to move to another state let alone another country. You can ask the father and your lawyer to work it out so your son spends the school year with you, the holidays and summer with his dad, or you can try to get full custody. Good luck hun!

The only way you can legally live in another country with your son is to get your ex's permission or go to court and prove to the judge that your move has a good reason.

You cannot take your son out of the country without the permission of the other parent under any circumstances - even if you had full custody this law would still apply.

No! You must stay in the same country as the other parent so they too can share in the child's life. Remember every negative thing each of you say against the other is like a knife in the child's heart. They think each parent is special and love them with all their heart. It's hard to but put the child first but I hope you both can do so.

when you go in for the custody hearing ..you have to come to an agreement if you will be allowed to leave the state or not. it would be easiest if you both came to an agreement ..and even better if you didnt leave the country... good luck..i couldnt imagine not seeing my child for 6 months of the year..

You can only do what the divorce papers allow you. Not allowing your spouse to have reasonable visitation is usually not allowed. You need to work this out with your attorneys but I can't imagine that your son or ex would not want to have visitation that didn't involve expensive, long distance travel. What a shame.

Within the US it is very hard for a parent to move to another state with the child, let alone move out of the country since once you leave the US, the courts have no jurisdiction

yes...my husbands ex took their kid to germany and lived there 3 years..and if you do have 50% custody you have to pay for the tickets for him to come and go

you should be able 2 live where ever you want 2 live after the divorce but you and you ex would have 2 split the price of the plane ticket 4 you child 2 visit his father
