I am thirty three and I have this friend of mine that I've known since I was like 7 or 8. Well she has a son who's eleven and has been with his mom, my friend, since he was born. The father to him hasn't tried to see him except maybe once a year....if that. This past weekend that father calls her, my friend, and threatens that he's gonna take custody of that son. He cannot do anything right? My friend is a durn good mommy and has turned out nothing like her mom...who used to beat her....she is totally gone the different direction and is a very good mom and goes to college and takes good care of her son...even tho she is taking care of business...she does want a boyfriend but that Dad cannot come out of the blue and take that boy away can he?? He only has visitation I believe but doesnt she need to file harrassment charges and file a restraint? Please I need to help her and show her that the Dad cannot just come in and take him away from her right???

HELL NO! HE CAN'T JUST COME IN AND TAKE HER SON AWAY. THERE IS ALOT INVOLVED THERE, THE FIRST THING SHE NEEDS TO DO IS PETITION FOR CUSTODY FOR HER SON AND GO AFTER THE NON-CUSTODIAL PARENT FOR CHILDSUPPORT. THEN SHE NEEDS TO HAVE IT PUT IN THE CHILDSUPPORT PAPERS THAT HE CAN'T CLAIM THIS CHILD ON HIS TAXES EVEN IF HE PAYS CHILDSUPPORT. THE COURTS WILL QUESTION HIM ON WHERE THE HELL HE'S BEEN FOR HOWEVER LONG. AND JUST BECAUSE YOU'VE BEEN THROUGH ABUSE AS A CHILD DOESN'T MEAN THAT YOU AUTOMATICALLY DO IT TO YOUR OWN CHILD...YOUR FRIEND SEEMS LIKE SHE HAS HER HEAD ON STRAIGHT GOING TO SCHOOL AND TAKING CARE OF A CHILD BY HERSELF, THAT'LL CARRY HER A LONG WAY IN FRONT OF THE COURTS. hey im rebecca and let me say that is rude and unfair my dad has never ask for custied over me but he did ask to keep me . look im going to tell you the truth the justies stystem douse not allways come thourght, but i will tell you this if she has a good living envioment a steedty pay check a good job a ediucation and a good enogh reson then she has a heck of a chance. AND IF THIS RUDE MEAN UPSERD VILE MAN has a record of any sort (by how you discribed him it seemes he would). or if he has harrassed her like you said , and hasent seen that child fore qiut a while andONLY ONES A YEAR THER IS NO WAY that juge is going to let him keep that child look the worst thing that can happen to a child is this staying up all night wondering if thell be tooken away its a scary feeling and im so sorry for her and teel her that she has one heck of a chance im realy sorry i hope it gose ok

There's no way that dead beat is gonna be gone for 11 years, and then come and take HER son away from her. especially after she's done ALL the parenting. Tell your friend not to worry

No, it's almost impossible for a father to get custody so if the mom is doing a great job as a mom I can't see how she could lose her kid. At least that's how I think it works.

Nobody can take a child just because they want it. They would have to have a VERY good reason to take a child away from his/her mother.
A lot of men threaten to do this to get out of paying child support.
Worst case scenario would probably be that he has to pay child support & just get visitation.

I dont think he can just take her son. Does he pay child support. He can only take hime away if he proves she is an unfit mother, but by your description, she is a loving and nourturing mother who only wants what is best for her child.

are they divorced or did the father just leave? if hes divorced than i thinks he has rights...but if hes as much of a smuk as u say, im SURE he wont get custody over his son. WHAT AND IDIOT! WHY THE HECKELL WOULD HE OUT OF THE BLUE WANT HIS SON?!

This is legally complicated. Fathers, no matter how indifferent they've been do have rights. Get a good lawyer immediately!!

he should not beable to do that maybe you could have the son decide who he wants to be with
