The tricolour has absolutely nothing to do with the Indian national flag flag.
The problem would arise if the cake had the emblem of the ashok chakra in it. According to a a Govenment directive, just the combination of the tricolour - saffron, white and green, does not constitute the national flag. This was mentioned in a case where the Indian cricket team had sported a splash of of the tricolour on their uniforms.
More here: http://www.flagwire.com/index.php?doc=28&aid=53
If the cake had no Ashok Chakra emblem on it, no case can be made out of it - because it is just a combination of colours and it isn't a flag. Next time, these stupid Aaj Tak guys will sue the rainbow.
And in any case we are making too much of a fuss about it.

It has been clarified that he was not at all aware that the colour of the cake resembles with Indian Flag. The function was organised by the Indian High Commission and he was asked to cut the cake. He did not give pareticular attention while cutting the cake that it resembles the National Flag. Actually the Indian High Commission should be blamed for arranging a cake which resembled National Flag.

It was for publicity. Yes, stern legal actions should be taken against him irrespective of him being a so called great player. No body is above the law of land. When Salman Khan , a Hindi film star was involved in poaching , he was given an ordinary treatment by a jail in Rajasthan to set an example of implementation of law strictly. Now is the time to punish this so called great cricketer similarly as per law without reducing the amount of punishment by even least possible amount. Everybody is equal in eyes of the law. He has participated in 'cake cutting & eating event' equivalent to cutting India & consuming one's part like a corrupt politician. If at all he had any commonsense & shame , he would not have participated in that . He is not an innocent minor child that he does not understand the meaning. When Kapil Dev was tempted by bookies to tarnish the images of him & Manoj Prabhakar simultaneously, he sensed rat smell & kept him out of it tactfully & that match to be deliberately lost was canceled. When he was asked about on TV , he broke down completely but his real pain was not highlighted by any media man. Now it is the time to see what the response of Tendulkar is.

I don't know how indian media etc would treat this thing.......but in my opinion this is not a big issue for taking a legal action against !! treating it like some big issue would be extremism....Ofcourse he did not mean to insult the flag.... he is the one who has done a lot for this flag !!

I am totally against that. It should not be. National flag should be given the due respect. Even, The first person, The president don't have rights to dishonour the National Flag.
