Our neighbors have parties every weekend, they are not terribly loud but they do use profane language just a few feet outside our daughter's window. I have asked them to either clean it up or take it inside but they have no respect for my desire to protect our child from their horrible language. What can I do and what laws are there to protect our child?

Most states actually have laws against profanity. Several years ago in Michigan, a man was sentenced to 45 days in jail for swearing (profusely -- he was drunk) while a group of Boy Scouts were canoeing near by. It's not something the folks in law enforcement like to take the time to address, but push come to shove, they will. When next your neighbors begin to whoop it up and the language starts to fly, call the police and complain. Ask to know the name of the person with whom you are filing the complaint, note the date and time -- letting them know you mean business. After several calls, something will probably be done about it If not, get a lawyer, show them the documentation and file a suit in "Civil" court. If you live in a community that has a home owners association, register your complaints there first. If tey are renters, file a complaint with the owner or their management company. Enough complaints get filed and they'll not be allowed to renew their lease.

Profanity on private property, even if it can be overheard, is protected speech under the First Amendment.

You can sue for nuisance, but you would have to prove they are a nuisance on a neutral basis.

You can try and reason with these people or just put up a solid, tall, ugly fence. They'll get sick of looking at it and take their party inside.

I do believe you can call the police for disturbing the peace. Ideally, you would want to talk to them and resolve this amicably first, however you have already tried that to no avail.
