I wanted to know if anyone had any idea if it is illegal or problematic to put a stop on a check of a car I had just purchased from a used car dealership. The owner did not mention that the car had transmission problems, and now the transmission is about to go. I realize I should have noticed this problem, but when I drove it I didn't drive very fast because the dealership said they needed to put new brakes and routers on. Therefore, I didn't get a chance to see how well the car shifts at high speed. As far as I know you can pour certain things into a car to help the transmission work temporairly as well. Anyhow I figured maybe I can put a stop on the check, and go speak to him claiming that he did not inform me of the problem.

The car was bought "as is." Therefore, normally I would have to take responsibilty for the repairs, but the transmission problems has not been voiced to me.

When I test drived it they said it just needs new routers and brakes because it was sitting around so long, nothing else.

Call the previous owner before you go ahead and stop the check, but you have to be with that car at the previous owner to return it. It depends on the wording of the paperwork and how the car was described, and since they said they needed to make repairs when you test drove it, maybe they aren't done. Communication is important before taking action against them. Previous owner can not misrepresent, but when buying a used automobile, it's buyer beware! You might have a hard time, but be prepared, you might get stuck with the car and the fees for the check.

If the cheque has not been cleared, go ahead and place a stop-payment. have the dealer fixed all the problems before advising the bank to clear payment. You will need to ack fast though because these days cheque clearance takes only 2 days.
