i have a friend that has child support taking out of his check but the company he works for has not turn it over to the state in over two years the polices came and picked him up and held him in jail for over a week after his wife took all his pay stub's to his attorney and proved he payed his child support , i can't understand how can someone sleep at night knowing that they are stiling food out of little kids mouth and what about if the kids have to go to the doctor are these people that gready and money crazy his attorney is doing every thing he can but nothing so far is there and old law or something i can tell him

That's normal for a Trucking Company. They want your money more than the kids need it. The stubs prove he paid so now he has to deal with the real American Justice System. The innocent in jail is not unusual. Next letter try the spell check.

Ultimately the man is responsible for making sure his support obligations are being paid.

Every month the State send out a itemised list of money received from the father and in turn it list the payments made to the mother. At what point do you allow the employer to not send it in when you see this going on. He obviously does not care whether or not his money was being sent in or not or this would have never gone on this long.

HOWEVER, an employer is legally responsible for collecting and mailing in all payments according to the laws of the state. If the employer has failed to do this they can be held financially liable for all cost end expenses as well as facing penalties for failing to abide by a court order. Contact the State Attorney General and find out what steps need to be followed to address this situation and resolve it as fast as possible.

Also have your friend find a new employer that will follow the laws, because if they were willing to do this what other taxes and monies have they been deducting from employees and not sending in to the appropriate agencies.

Just like taxes, it is HIS responsibility to make sure the payments are made. That said, if he can prove his employer withheld the money and fail to forward it to the appropriate agency, he has grounds to sue the employer for the amount withheld and any associated penalties. He should also petition the court to release the garnishment on the grounds the child would get the funds sooner if he were permitted to write a check. If the employer is not currently the DEFENDANT in a lawsuit, the attorney IS NOT doing everything they can.

(If I were the DA) I would be suspicious of the company showing the deduction on one check and issuing the employee a seperate check for the support amount(or paying it to him under the table). If the state discovered this was the case, I could understand the arrest.

Here is my opinion, Welcome to The New World Order, I urge you to find a new and good lawyer to sue The company he works for.Make sure he receive benefits and settlement before he decides to do anything. You forget that this is 21th century people are glue to Green Money. There are so many lawyers out there who can do anything for green money. By the way,I am not sure he can sue the state that took him to jail for a wrong doing. Double check if he has a strong case. Find out from the law library clerks in his area to see if you can find Pro Bo-no lawyers who can advice him before he takes an action.

I disagree, the idea that the State has become the agent for mom's to enforce support orders has done much to increase the divorce rate in this country. Illegitimate children are like illegal aliens, what makes one more legitimate than the other.

It is still your friends responsibility to make sure the company garnishing his paycheck is sending it in. Sure he can prove it by check stubs but he has to make sure they are doing their part. Have him call the Office of Attorney General in his state. They will tell him the same thing.

well its refreshing to see its not just females who think men are just a source of income and have no responsibility to reciprocate responsibility. Its about time someone else took advantage of men paying child support....I'm surprised that the government doesn't double tax the child support....charging taxes on the man making it and the woman collecting it.... and who are we fooling...its never been about the children.....because if it was about the children governments would legislate mandatory dad time....... and mandatory mom time....

As long as your friend has his paystubs to show his company had witheld the chils support things will work out in the long run, and it may be a very long run. As far as the courts are concerned he has not paid his child support. He will need to file a civil and or criminal suit against his employeer.
