If the english spelling for the name was used then it would be a whole different name, that would be very ignorant

No, they cannot, generally speaking. A few places will allow it, but quite frankly...if you are in the USA, you should be using the English spelling...

Legally, I don't know. Practically, I doubt most of the computers used to produce the documents in the US are set up to accept the accented letters.
