i want to know all the legal procedures that i have to go threw in details if im going to go threw with it! is there a court fee and if they have to hear person that i want the restraining order side from too?

usually a restraining order has a life of a number of days. it is a prelude to the issuance of a preliminary injunction which is more permanent and will last until the duration of the trial. for a restraining order, no bond is required but for an injunction you have to post a bond.

of course i am talking about philippine jurisprudence.

There is deffinately a fee, and you have to pay even more if you want it to go through a lawyer. And no, unless there are no prior complaints, or problems filed by the police. Try making a report the next time something happens, that way they at least have something on file. Usually though, there is nothing that can really stop a determined person.

There is a filing fee. You may have to have proof of threat or harassment. Call your local DA's office, local magistrate or clerk of court and they can tell you how to do it, what is required, and the filing cost.
The bad thing is, the order has to be violated for the courts to take further action - sometimes it is too late by then - it turns into a murder investigation.
