You have to be liscenced for that by being in law enforcement or a public servant required to wear one. Besides that, the courts have to grant you the permission for wearing one. One being that your life is at high risk due to a public matter.

Only if you're an authorized, licensenced law enforcement professional with a commissioned badge, a duly authorized emergency services professional or officially active military uniformed soldier exposed to areas of possible gunfire--which I hear is quite common in NYC.

Truthfully, probably yes. Its probably illegal to use them to commit a crime, though. Like robbing a bank using a gun and bullet proof vest.
