Yes, probably because he is over 18 and she is underage. If she ever gets pregnant or her parents find out about them having sex they can go to the police and file charges against him. Tell him to find a girl his own age (over 18) or to hold off having sex for a long time. Or his GF needs to be on the pill and use condoms if they have sex because charges really only happen if there is evidence of sexual conduct (ie pregnancy).

In a word: YES. Doubts exist that their State of residence allows age of (sexual) consent at 16; most all US states set the age when she (or he) blows out their 18th birthday candle.
Bottom line: they engage in sex now, by the law's view--boyfriend is a rapist--in league with the REALLY violent ones....and can be sent to prison, where he could be a cozy cellmate to a horny poor hugely muscular soul. Tell boyfriend it's only two more years of cold showers......he can hold out.

Technically, it is not Statutory Rape, it is unlawful sex with a minor because of the age. Still a crime, but a lesser charge. Misdemeanor vs. class 2 felony.

depends on the state. here in washington, no, it would only be illegal if he was more than three years older than her. however, if her DAD decides to say it was rape, then he raped her no matter what she says....
