he now has a concussion (not before the accident) and migraines since, he has also been pulled out of school becauseit has affected his thought process.

Have you contacted the insurance company of the person who hit him? Also submit a claim to your own insurance company for PIP or Medical payments coverage, as well as uninsured/underinsured motorist coverage. Hopefully you are getting treatment for him.

If the insurers do not respond, you will need a lawyer. Try to settle on your own first, since the lawyer may get you another 10% or so, but will take 33% of the settlement to do it. FYI - any money you get goes to medical bills, then into trust for the kid.

Also, don't expect a huge or even large settlement. The driver won't have that much insurance, and even if they do, you have to prove there were no migraines before the accident, and that this is not a transient or genetic condition. It's very, very hard to prove.

Was it the drivers fault?

If your kid was not following the rules of the road, like cutting across the street not yielding to vehicles already in the flow of traffic, there isn't anything you can do.

If it is the driver's fault contact the driver's insurance company, if what they are willing to settle on is less than you expect get a lawyer. Do not pay for the lawyer upfront. Make sure he is willing to work for a precentage of your winnings.

The insurance company will probably pay your medical bills just to avoid the hassle of a lawsuit. If you sue you will have to prove the driver was at fault. When my son was 9 was he was hit by a car while riding his bike. He said it wasn't his fault but when I finally got the details out of him I realized that there was no way the driver could have avoided the accident.

Devil's in the details... your answer all depends on the police report of the accident. Was it done maliciously? Was the driver impaired? Was the driver doing anything that could have been seen as incompetent? Was your child playing in the street? Honestly if you really want to pursue anything you should call a personal injury attorney.

Sue the crap out of them!!!!! Trust me, if you can prove the incident, you will make a killing. But don't do anything physically to the person. You'll end up in jail and your child really needs you.

did you get the license number and name of the person who hit your child?=you can approach his car insurance company and not only have him charged ,but get a settlement and your childs bike replaced and clothes if they were ripped=good luck=you can also have his insurance company pay for hospital bills and any meds the child might need

It depends, If my kid was being the stupid one and didn't look before crossing the road then I wouldnt persue any legal action. If it was the cars fault then i would sue.
