i got put on 5 yr felony probation 2 yrs ago for complicity to theft...the two other guys that got charged for theft that i was with got there cases dismissed..i was wondering if there is anything i can do to get off because it doesn't seem right that i got charged with compliciting to a crime that got dismissed. Its been almost 2 yrs since this has happened. Is it to late to try and get an appeal..or what? I don't even know how I would go about doing this or what the word is called. Any info???

Yea, just get a lawyer and petition the Governor. All you need is for him to either commute your sentence or pardon you.

I have to admit this puts your other question into a much brighter/harsher light btw.

Get a good Lawyer, like the other two guys. UNLESS you were the main one doing the theft. NO it is not to late. When you see a Good Lawyer, He/She will guide you. Try to get it dismissed , as a Felony will stay with you, for a long , long time. You will not even be able to vote. Until then, make sure you walk the straight and narrow. Don't get in anymore trouble or you will continue to slide downhill.

oftentimes a challenge of probation is that you have not any police contact and in case you do have police contact you need to record it on your PO. They likely gave it a case # because they filed a record. in simple terms because the police didnt arrest you or cite you doesnt mean that you gained't get a summons to come back to court docket on something like a disorderly habit charge or a quotation for that. It relies upon on the position you stay and what the district attorneys do on your section.

Maybe you should mention why it took 2 years for you to think about an appeal? If their charges just got dismissed it might be because they went all through court to fight it and you just took the sentence.

Obviously you did the crime, other wise they would of dismissed your case too. So you did the crime, now pay the time, and at least your not jail

Its too late, unless you can get a pardon from the governor, The only way to get off probation is to violate its terms and go to jail.

why did you confess? i only hope you learned your lesson and won't be complicit in any more thefts. remember, you're being punished for what YOU did, not for what anyone else did. so if you did the crime, do the time and quit whining about it
