my question is if i was to divorce. is my wife entitled to 50% of my pension? we have been married for aprox 2 years. a friend of mine told me in order for her to get anything we must be married for 12 years. the pension website does not have no info on this . fyi i am not looking at a divorce just want to be armed with knowledge , man shall die for lack on knowledge

I always hear it is ten years. But I don't think you will find the answer on the pension website. It's NJ law that makes it ten years.

in NJ divorce law one spouse can receive a portion of the other's pension. how much is a different question that's very complicated and subject to negotiation and judicial rulings. depends on whether you have kids, whether she worked during the marriage, how much money you have in proportion to how much she has. like if you earn twice as much as her that would weigh in her favor. If you were only married 2 years I would think she would only get a small piece.

In order for your wife to be able to recieve your SS while you are alive, you must be married to her for ten years.. If you die, it won't matter to you any..lol Sorry had to say that.. Go to your benifet department and ask.. They are there to answer those questions for their employees..

Tell em some guys on the beat were arguing about it..lol.. no one will ever know..
