What if I have a home video and I add music in the background, but I put the name of the artist and song in the video, is it considered copyright infringement?

Yes , under the US copyright act section 106 rights you would be violating the copyright owner's rights by reproducing his work without consent or license.

There is a clause called the Fair Use Doctrine. Making a reproduction of copyrighted material for your own personal use is considered fair use or copyrighted material. But the key here is that it has to be for your own personal use.

Basically, if you have a home video and add music in the background, you aren't infringing the artists copyright as long as you only make that one copy for you own private use. If you make any additional copies, then you would be in violation of the law, unless you have specific permission from the copyright owner or have purchased a license to reproduce the copyrighted material.

Strictly speaking, yes, you'd be violating the right to reproduce under 17 USC 106. However, it's highly likely that you'd have a fair use defense since your use is personal in nature and minimal at best.

if a home video is for viewing in the home, then you have every right to enjoy the music as you like.

As long as it's not for resale or multiple copies I wouldn't think so. It would be the same as putting it on your ipod, I would think. If you were to mass produce this video or show it on public airwaves I think you may have an issue.
