At my husbands job, the company has asked the employees to order new uniform shirts at no cost to them. But when it came time for the men to pick up the t-shirts, they were told that they had to pay $60 for the once free shirts! That's $60 for only 3 t-shirts with the name of the company at the back. No special design or material. That price is excessive! But they were told that they had to buy the shirts or be fired.

A friend of ours told him to get an itemized receipt--and not one the secretary typed up! We were told we could use the receipt for tax purposes and personal knowledge and proof that the company is not cheating him.
What's more is that they want cash and not to take it out of their checks.

This is the same company that ended paying for overtime, ended offering benefits, ended giving raises, and on the payday told the men that they wouldn't be paid for a whole nother week! All of the changes were very sudden. They received no warning for anything.

Do we have legal rights in this situation?

For the overtime, they all of a sudden made them work some weekends instead of hiring part time people. It was okay at first because of time and a half, but now they won't pay that. They make everyone take a day or two off instead! So bye bye weekend and no extra pay!

The owner of the car dealership "closed" down the company my husband was hired for and reopened under a different name. (Very fishy to everyone). He then proceeded to screw the workers over in the ways described already.

Concerning the t-shirts, they already had uniforms. These were supposed to just be extra shirts. So this is not a new uniform per se. Why are they being made to pay (and so much!) for extra shirts?! Buying bulk t-shirts with a name/logo doens't cost $20 a piece!

The events you described sound like big red warning flags that the company is about to go under. As far as the money that he paid out, he may be able to deduct that amount on his taxes; he will need to consult a tax expert for details.

It may be a good idea for your husband to update his resume and look for a new employer.

As far as legal recourse, he may have legal recourse, but he will have to determine if it is worth pursuing, given that you are talking about $60.00. He should consult a lawyer in your area for details.

As far as the over-time, the manner in which they are paying, MAY be illegal, however, it will likely depend on the laws in your location. I am fairly certain that, under US federal laws, as long as they don't make him work more than 40 hours per week, or more than eight hours per day, they don't have to pay overtime. It is up to the company to set work hours and days. Check with the EEOC (http://www.eeoc.gov/) or your state, or location's equivalent.

Anything that is considered a required work expense you can get back on your taxes. I have a question about the overtime part though. Did they end overtime altogether? As in, making sure employees don't get any? Or, do they have people working over 8 hours with no overtime compensation? If its the latter, that is illegal and I suggest that your husband call the labor board.

If you cant prove that the t-shirts were suppose to be free then yes you had a verbal contract. $60. is way to much for advertising their company. The fact they want cash makes me think its not for the 3 t-shirts but their stealing their money. If I were him I'd hunt another job this company sounds they have bad business practices. If they want you to wear a uniform the company usually pays for it. I know we do. If this company stopped benefits, and ended pay raises then they don't sound like their making enough money. By the way they cant stop paying overtime legally either.

Pl ask your husband/employee to write a letter to the president.

Pl mention that you would like to see the names of the persons who were in the comittee to order new uniform shirts. Pl ask the president for involvement of the people who can bargain for the lower price.

Pl send the copy of the letter to all.

The only thing I can think of is to try to claim it on your taxes as an "Unreimbursed Business Expense".

But you will need a receipt.

I think it's time to re-think the relationship with the company.

There are other employers, there are self-employment opportunities, and there are unions that would be happy to organize the business.

It may not be fair, but I don't know what you can do about it beyond finding a new employer for your husband. Good luck.

They cannot require a uniform without a clothing stipend.
