My cellphone was stolen and used while in custody now the company says i have to pay it can someone please tell me is it possible for me to argue this I have proof of incarceration I just do not think it is fair for me to pay when I did not use it.

My goodness, I am really sorry to hear that!! Your best bet would be to contact a supervisor at the cell phone company and explain your situation.. You may even have to fax them your proof of incarceration.. You should write down the times, dates and names of people you speak to from that company.. Also, you should write them a letter explaining your situation.. If they ask for it, send them a copy of your proof of incarceration.. If you still can't get anywhere, try to contact their Collections department and see if you can get some sort of a settlement.. I worked for a collections company not too long ago and I can tell you from my experience, the company getting a settlement amount is way better than them getting nothing at all!! I just hope that you get a nice person that can be sympathetic with your situation.. And I hope that your cell phone wasn't used for too long.. If it was, then that company should have shut it off right away when they knew they weren't receiving any payments!! I'd say that's on them!! Good luck.. I hope everything works out for you..

While you do have the proof that you were incarcerated at the time might and might not prove anything. The company more so than none will say that you let someone hold the phone, after you were released did you filed a report stating that the phone was stolen, if not, it looks like you will be paying for the charges.

I hate to see anyone have stuff stolen. Maybe there was some poetic justice at work here.

sometimes its good to sign contracts and sometimes its not...u can call a lawyer ...the ones with free advice and ask,but if u signed a contract i dont think u can avoid it...they have to get thier money,its not there fault u went to jail and didnt figure it out . not being rude just think thats what they would say when u sign a contract
